WAIVER

Legal Disclaimer

PARTICIPANT WAIVER, ASSUMPTION OF RISK, MEDICAL AUTHORIZATION AND MEDIA RELEASE

 

Please read this agreement carefully. By clicking “I ACKNOWLEDGE AND AGREE,” you confirm that you have read, understood, and voluntarily accepted all terms below.

Assumption of Risk

I understand that participation in Push Development basketball training, practices, games, conditioning exercises, transportation, and related activities (“Program Activities”) involves inherent risks.

These risks may include physical contact, collisions, falls, overexertion, equipment-related injuries, sprains, strains, fractures, concussions, serious injury, illness, property damage, and other risks that may be known or unknown, foreseeable or unforeseeable.

Participation may also involve exposure to communicable or infectious illnesses, including influenza, COVID-19, MRSA, and other infections. I understand that following safety rules and exercising personal discipline may reduce—but cannot eliminate—these risks.

I voluntarily permit the registered participant to take part in the Program Activities and knowingly accept all risks associated with participation.

Participant Health

I confirm, to the best of my knowledge, that the participant is physically capable of participating and has no medical condition that would make participation unsafe, except for any condition disclosed to Push Development.

I agree to notify Push Development of any injury, allergy, medical condition, medication, or physical limitation that could affect the participant’s safe involvement. The participant will follow all reasonable safety instructions and immediately notify a coach if experiencing pain, illness, dizziness, breathing difficulty, or another concerning symptom.

Push Development may limit or discontinue participation when reasonably necessary to protect the health or safety of the participant or others.

Release and Waiver of Liability

In consideration of being permitted to participate in the Program Activities, I release and discharge Push Development and its owners, directors, officers, coaches, employees, volunteers, agents, contractors, sponsors, and participating facility owners or operators (“Released Parties”) from claims arising from the ordinary and inherent risks of the Program Activities, to the fullest extent permitted by law.

I understand that this release is intended to include claims arising from the negligence of a Released Party where such a release is legally enforceable. It does not release gross negligence, intentional misconduct, or any liability that cannot legally be waived.

If I am signing for a participant under 18 years of age, I provide this release regarding my own claims as the participant’s parent or legal guardian and, only to the extent permitted by law, on behalf of the minor participant.

Nothing in this agreement is intended to waive a legal right that cannot lawfully be waived.

Emergency Medical Authorization

If the participant requires urgent medical attention and I cannot be reached promptly, I authorize Push Development representatives to provide reasonable first aid, contact emergency medical services, and share relevant medical or emergency-contact information with first responders or healthcare professionals when reasonably necessary.

I understand that Push Development representatives are not medical professionals unless specifically identified as such and will use reasonable judgment based on the circumstances.

I accept responsibility for medical or related expenses arising from the participant’s involvement that are not covered by provincial health insurance, private insurance, or another applicable benefit plan.

Transportation Authorization

I authorize the participant to travel to or from Program Activities in a private vehicle operated by a coach, volunteer, parent, guardian, or other adult authorized by Push Development when transportation is arranged as part of a Program Activity.

I understand that travelling in a motor vehicle involves risks, including collision, injury, or property damage. This authorization does not waive automobile-insurance coverage or any statutory right that cannot legally be waived.

Photography and Media Release

I authorize Push Development to photograph, film, or otherwise record the participant during Program Activities. I grant Push Development permission to use the participant’s image, voice, or likeness for legitimate promotional, advertising, informational, and program-related purposes.

These materials may appear on Push Development’s website, social-media accounts, digital advertisements, printed materials, registration pages, program highlights, or other promotional platforms.

I understand and agree that:

  • No financial compensation will be provided;

  • The participant’s full name will not be published without additional consent;

  • Photographs and recordings may be edited, reproduced, published, or distributed;

  • Content published online may be copied or shared by others beyond Push Development’s control; and

  • I may withdraw permission for future use by providing written notice to Push Development, but withdrawal may not apply to materials already produced, printed, published, or distributed.

Electronic Acknowledgment

By clicking “I ACKNOWLEDGE AND AGREE,” I confirm that:

  • I am at least 18 years old;

  • I am either the registered participant or the participant’s parent or legal guardian;

  • I have the authority to complete this agreement;

  • I have carefully read and understood this agreement;

  • I understand that this agreement affects legal rights;

  • I have had the opportunity to ask questions before agreeing; and

  • I voluntarily accept all terms of this Participant Waiver, Assumption of Risk, Medical Authorization and Media Release.
